Acceptance of Terms
These Terms of Service ("Terms") govern access to and use of the DriverProof application, website, and related services (collectively, the "Services").
By creating an account, accessing, or using DriverProof, you agree to be bound by these Terms, the Privacy Policy, the Definitions & Governing Principles, and all other documents contained within the DriverProof Legal Center.
If you do not agree to these Terms, you must not access or use the Services.
Eligibility
You represent and warrant that you:
Are legally capable of entering into a binding agreement.
Will use DriverProof in compliance with all applicable laws and regulations.
Will provide accurate account information.
Will maintain the security of your account credentials.
You are responsible for all activity occurring under your account.
Purpose of DriverProof
DriverProof is a documentation platform designed to assist users in recording vehicle inspections and preserving inspection records.
DriverProof does not:
Perform vehicle inspections.
Certify inspections.
Repair vehicles.
Guarantee vehicle safety.
Provide legal advice.
Provide regulatory compliance certifications.
Responsibility for safely operating and maintaining vehicles remains with the driver, carrier, owner, or other responsible parties.
User Accounts
Users are responsible for maintaining accurate account information.
You agree to:
Keep your login credentials secure.
Notify DriverProof of unauthorized account access.
Maintain current contact information.
Use only accounts registered to you or your organization.
DriverProof may suspend or terminate accounts used fraudulently or in violation of these Terms.
User Responsibilities
You agree to use DriverProof honestly and responsibly.
You shall not:
Submit knowingly false inspection information.
Misrepresent inspection results.
Attempt to manipulate inspection timestamps or metadata.
Upload malicious software or harmful content.
Attempt to interfere with the operation of the Services.
Use DriverProof for unlawful purposes.
Users remain solely responsible for the accuracy of the information they submit.
Inspection Records
Inspection records represent the information submitted by the user at the time an inspection is finalized.
Once finalized, inspection records become part of a permanent inspection history and are preserved in accordance with the Data Retention & Record Integrity Policy.
DriverProof does not ordinarily permit finalized inspection records to be edited or deleted.
Ownership of User Content
Users retain ownership of the inspection information, photographs, notes, and other content they submit.
By submitting content through DriverProof, you grant DriverProof a non-exclusive, worldwide, royalty-free license to:
Store submitted content.
Process submitted content.
Generate inspection reports.
Preserve inspection history.
Display content to authorized users.
Operate, maintain, improve, and secure the Services.
This license exists solely for the purpose of operating DriverProof.
Subscription Services
Certain DriverProof features require a paid subscription.
Subscription billing, renewals, cancellations, refunds, and access are governed by the Subscription Terms.
Availability of Services
DriverProof intends to provide reliable and continuous service.
However, the Services may occasionally become unavailable due to:
Scheduled maintenance.
Software updates.
Internet disruptions.
Infrastructure failures.
Third-party service interruptions.
Security incidents.
Circumstances beyond DriverProof's reasonable control.
DriverProof does not guarantee uninterrupted availability.
Intellectual Property
Except for User Content, all DriverProof software, designs, logos, graphics, trademarks, documentation, source code, and related materials remain the exclusive property of DriverProof or its licensors.
No ownership rights are transferred through use of the Services.
Prohibited Conduct
Users may not:
Reverse engineer the Services.
Attempt unauthorized access.
Circumvent security measures.
Copy or redistribute DriverProof software without authorization.
Interfere with other users' access.
Use automated systems to abuse the Services.
DriverProof reserves the right to investigate suspected misuse.
Suspension and Termination
DriverProof may suspend or terminate access when reasonably necessary to:
Protect platform security.
Investigate fraud.
Prevent abuse.
Comply with legal obligations.
Enforce these Terms.
Termination of account access does not necessarily eliminate record retention obligations described elsewhere in the Legal Center.
Disclaimers
DriverProof provides a documentation platform "as is" and "as available."
To the fullest extent permitted by law, DriverProof disclaims warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
DriverProof does not warrant that:
The Services will always be available.
Every inspection will satisfy legal or regulatory requirements.
Every report will be accepted by every employer, insurer, court, or governmental agency.
The Services will be free from interruptions or errors.
Limitation of Liability
To the fullest extent permitted by applicable law, DriverProof shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the Services.
DriverProof's aggregate liability arising from these Terms shall not exceed the amount paid by the user to DriverProof during the twelve (12) months preceding the event giving rise to the claim, unless otherwise required by applicable law.
Indemnification
You agree to indemnify and hold harmless DriverProof, its owners, employees, contractors, and affiliates from claims, damages, liabilities, and expenses arising from:
Your use of the Services.
Your violation of these Terms.
Your violation of applicable law.
Your submitted content.
Governing Law
These Terms shall be governed by the laws of the State of Utah, without regard to conflict of law principles.
Any legal proceeding arising under these Terms shall be brought in a court of competent jurisdiction located within the State of Utah unless otherwise required by applicable law.
Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with the documents contained within the DriverProof Legal Center, constitute the entire agreement between DriverProof and the user regarding use of the Services.
Changes to These Terms
DriverProof may revise these Terms from time to time.
Material revisions will become effective upon publication or as otherwise required by applicable law.
Continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms.
