Purpose
This Definitions & Governing Principles document establishes the foundational terminology and guiding principles used throughout the DriverProof Legal Center.
Unless otherwise stated, the definitions contained within this document apply to all DriverProof policies, agreements, and legal documents. In the event of any inconsistency, these definitions shall govern unless a specific document expressly provides otherwise.
Governing Principles
DriverProof was created to provide drivers, fleets, and other authorized users with a reliable system for documenting vehicle inspections and preserving inspection records.
Every policy contained within the DriverProof Legal Center is built upon the following principles.
Documentation Preservation
DriverProof exists to document inspections—not to modify history.
Inspection records are preserved to maintain an accurate historical record of information submitted at the time of inspection.
Record Integrity
Once an inspection has been finalized, DriverProof preserves that inspection as a permanent historical record.
Original inspection records are not edited, rewritten, or replaced after finalization. Corrections or additional information are documented through subsequent inspection records rather than alteration of the original record.
User Responsibility
DriverProof assists users in documenting inspections.
DriverProof does not replace the responsibility of drivers, fleet operators, mechanics, carriers, vehicle owners, or any other responsible party to properly inspect, maintain, or safely operate vehicles.
Transparency
DriverProof is designed to accurately document what was submitted by the user at the time of inspection.
DriverProof does not intentionally alter inspection content, photographs, timestamps, GPS information, or other submitted documentation after an inspection has been finalized.
Documentation, Not Certification
DriverProof records inspections performed by users.
DriverProof does not certify that an inspection was performed correctly, guarantee the mechanical condition of any vehicle, or represent that a vehicle complies with any applicable law or regulation.
User Ownership
Users retain ownership of the inspection content they create.
DriverProof receives only those rights necessary to securely store, process, display, preserve, and provide access to inspection records in accordance with the Terms of Service and Privacy Policy.
Good Faith Operation
DriverProof intends to operate its services in good faith, maintain commercially reasonable security practices, and preserve inspection records in accordance with its published policies.
Nothing contained within these principles shall be interpreted as creating an absolute guarantee of uninterrupted service, perpetual availability, or perfect preservation under every circumstance.
Definitions
For purposes of all DriverProof legal documents, the following definitions apply.
Account
An Account is a registered DriverProof user profile used to access the Services.
Content
Content means any information submitted, uploaded, generated, or stored through DriverProof, including but not limited to photographs, inspection responses, notes, vehicle information, GPS data, timestamps, weather information, and generated reports.
DriverProof
DriverProof refers to DriverProof LLC, its software applications, websites, services, systems, employees, contractors, and authorized representatives, unless the context clearly indicates otherwise.
Inspection
An Inspection is the process by which a user documents observations regarding a vehicle, trailer, or other equipment using DriverProof.
An inspection represents the information submitted by the user at the time it was performed.
Inspection Documentation
Inspection Documentation means all information collected or generated as part of an inspection, including photographs, inspection responses, timestamps, GPS information, weather data, notes, metadata, and any associated records.
Report
A Report is the finalized PDF or other official record generated by DriverProof that summarizes an inspection and its associated documentation.
Services
Services means all software, websites, applications, cloud infrastructure, storage systems, communications, support services, and related functionality provided by DriverProof.
User
A User is any individual or organization that accesses or uses DriverProof.
This includes individual drivers, fleet administrators, carriers, company representatives, authorized reviewers, and any other person granted access to the Services.
User Content
User Content means all inspection information, photographs, notes, documents, and other materials submitted by a User through DriverProof.
Ownership of User Content remains with the User, subject to the licenses granted to DriverProof under the Terms of Service for the purpose of operating the Services.
Vehicle
Vehicle includes any truck, tractor, trailer, commercial motor vehicle, passenger vehicle, or other equipment documented through DriverProof.
Rules of Interpretation
Unless the context clearly requires otherwise:
Singular words include the plural, and plural words include the singular.
References to one gender include all genders.
Headings are provided for convenience only and do not affect interpretation.
References to "including" mean "including without limitation."
References to "may" indicate discretion, while "shall" and "must" indicate mandatory requirements.
References to "DriverProof" include its successors and permitted assigns where applicable.
Relationship to Other Legal Documents
This document provides the foundational definitions and governing principles used throughout the DriverProof Legal Center.
Additional rights, obligations, limitations, and procedures are contained within the remaining legal documents, including but not limited to the Privacy Policy, Terms of Service, Subscription Terms, Data Retention & Record Integrity Policy, Evidence & Documentation Policy, Security Policy, Fleet Administration Policy, and Acceptable Use Policy.
